Building a Candidate Agreement

Another valuable benefit to ITCC membership is the ability to participate in monthly education sessions that are truly educational. These sessions are designed to inform and engage the membership in topics that are trending, innovative and critical to the success of their certification programs. 

Our May education session was presented by Alan Thiemann, of Counsel for Han Santos. Alan has represented the assessment industry for more than 30 years, serving as first Legislative Counsel and now General Counsel of the Association of Test Publishers, an international trade organization, and for numerous testing organization and test authors. During this time, Mr. Thiemann has handled international licensing transactions, copyright and trademark filings, and a host of regulatory/legislative matters.

During his presentation, Alan emphasized that it is vital to have a Candidate Agreement because failure to do so means legal exposure. It is important to present the terms upfront before the candidate clicks their acceptance. The presentation focused on what really goes into an agreement. Do you include a notice of terms and conditions, which policies, what are the consequences of failing to agree and should you keep records and if so, what is the content and format.  

Security and privacy policy practices were shared. Along with a look into practice tests and offering sample questions, score cancellation and retest policies as well as score challenge policies.
